In these terms:-
“You” and “Your” means the person ordering goods from James Lister & Sons Ltd
“James Lister & Sons Ltd” or “We” or “Us” means James Lister & Sons Ltd whose registered office is
at Spon Lane South, Smethwick, West Midlands, B66 1QJ, England.

OUR CONTRACT
Our site invites You to buy goods from Us.
A legally binding contract with You will only arise once James Lister & Sons Ltd has received
payment for the goods in full from You and has sent You notification of acceptance
of Your order by e-mail to the e-mail address given by You in the order form.

PRICE
| 2.1 |
The price shown for any goods is only applicable to this website.
The price for any goods ordered by You will be the price shown on the website
at the time You place Your order and will include all taxes applicable from
time to time.

In addition to the price a delivery charge may be payable.
If such a charge is payable We will notify You before Your order is accepted by Us.

We will debit the price, plus any delivery charge, from Your debit,
credit or charge card prior to delivery.

CANCELLATION RIGHT
| 3.1 |
At any time between placing Your order and James Lister & Sons Ltd despatching Your
goods You can change Your mind about purchasing the goods and withdraw
Your order.
There is no charge for doing this.
To withdraw Your order simply notify James Lister & Sons Ltd in writing or call the
order helpline, in each case quoting Your order number.

Once You receive the Goods You are free to return them to James Lister & Sons Ltd
within 7 days of receipt if You are in any way not satisfied with them
provided that:-

You pay the costs of returning the goods to James Lister & Sons Ltd; and
|
| 3.2.2 |
The returned goods are received by James Lister & Sons Ltd in the same
condition they were delivered to You.

| 3.3 |
If You return goods or cancel Your order under paragraph 3.1
or 3.2 We will reimburse any sums received from You within 30 days by
recrediting Your debit, credit or charge card.

STOCK SHORTAGES
If the goods You order are unavailable James Lister & Sons Ltd will notify You as soon as possible
and suggest a suitable replacement.

PRODUCT DESCRIPTIONS
The product information and photographs contained within Our website are provided
for illustrative purposes only and We cannot warrant that they are accurate. If You
are in any doubt as to the precise nature of the product You wish to order, You
are advised to call Our enquiry line to discuss the product with one of our
sales advisors.

DELIVERING YOUR GOODS
| 6.1 |
James Lister & Sons Ltd will deliver Your goods as soon as possible after Your order is
accepted to the address You have provided on the order form and in any
event within 30 days of the day after Your order was placed.

| 6.2 |
Ownership of, and risk in, the goods will pass to You once they have been
delivered to You.
|
| 6.3 |
If You wish to arrange a specified delivery day then please call our
enquiry number to discuss this. Whilst We will endeavour to deliver in
accordance with Your wishes We give no warranty in this respect other
than as set out in clause 6.1.

DEFECTIVE GOODS
| 7.1 |
If Your goods are defective, either on delivery or a defect arises within
the following [6 months], You are entitled to return them to Us at Your
cost, provided You include written details of the defects.
If, on James Lister & Sons Ltd receiving the goods it appears they are defective We
will promptly:-
| 7.1.1 |
either replace or repair the goods; |
| 7.1.2 |
reimburse any reasonable postage costs You incurred; and |
| 7.1.3 |
return the repaired or replaced goods to You, free of charge. |

Except where You are a consumer, James Lister & Sons Ltd will not be liable for any
indirect or consequential loss or damage or loss of profits arising out
of our supply or failure to supply the goods to You.

The rights You have in paragraph 7.1 above do not in any way seek to
limit James Lister & Sons Ltd’s liability for death or personal injury resulting from
James Lister & Sons Ltd’s negligence and they do not limit any statutory rights You
have as a consumer.

USE OF CARDS
James Lister & Sons Ltd will treat your order as cancelled and will re-credit
Your debit, credit or charge card in the event You discover that Your card has
been used fraudulently by an unauthorised person to buy goods under this
contract.

GOVERNING LAW
This contract is subject to English law and the exclusive
jurisdiction of the English courts.
|
